Terms and Conditions (T&Cs)

Scope

The following Terms and Conditions (T&Cs) apply to all orders placed through our online shop by consumers. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are not primarily related to their commercial or professional activities. A trader is a natural or legal person, or a legal partnership, who acts in the exercise of their commercial or professional activities when concluding a legal transaction.

Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Dustyrosa, Kevser Atik-Labadi and Amr Labadi.

By listing products in our online shop, we make a binding offer to conclude a contract for these items. You can add our products to your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process. The contract is concluded when you accept the offer for the goods in your shopping cart by clicking the final order button. Immediately after submitting your order, you will receive a confirmation by email.

Contract Language, Storage of Contract Text

The language available for concluding the contract is German.

We store the text of the contract and send you the order details and our T&Cs in text form. For security reasons, the contract text is no longer accessible via the internet.

Delivery Terms

In addition to the stated product prices, shipping costs may apply. You can find more detailed information about shipping costs on the respective product pages or during the checkout process.

We only offer delivery via shipping. Self-collection of the goods is unfortunately not possible.

Payment

The following payment methods are generally available in our shop:

Credit Card

When you place your order, you provide your credit card details. After you are verified as the legitimate cardholder, the credit card company will initiate an authorization check, and the payment transaction will be carried out automatically, charging your card.

PayPal, PayPal Express

During the order process, you will be redirected to the PayPal website. To pay via PayPal, you must be registered there or register for the first time, authenticate with your login credentials, and confirm the payment instruction to us. After placing the order, we will request PayPal to initiate the payment transaction, which will then be carried out automatically. You will receive further information during the order process.

Amazon Pay

During the order process, you will be redirected to the Amazon website before completing the order in our shop. To process the order via Amazon, you must be registered there or register first and authenticate with your login credentials. You can then select the delivery address and payment method stored with Amazon and confirm the payment instruction to us. You will then be redirected back to our online shop to complete your order. Immediately after, we will request Amazon to initiate the payment transaction, which will be carried out automatically.

Purchase on Account via Klarna

In cooperation with Klarna AB (www.klarna.com), Sveavägen 46, Stockholm, Sweden, we offer purchase on account. Please note that Klarna's invoice option is available only to consumers and that payment must be made directly to Klarna. Installment Payment via Klarna

Klarna also offers an installment payment option, allowing you to pay flexibly in monthly installments of at least 1/24 of the total amount (but not less than €6.95). Retention of Title

The goods shall remain our property until full payment has been received.

Transport Damage

If goods are delivered with obvious transport damage, please report any such damage to the delivery carrier as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences for your statutory rights or their enforcement, particularly your warranty rights. However, doing so helps us to assert our own claims against the carrier or the transport insurance.

Warranty and Liability for Defects

Unless expressly agreed otherwise below, the statutory liability for defects applies.

For used goods, the following applies: the warranty is excluded for defects that occur after one year from the delivery of the goods. Defects that occur within one year of delivery can be claimed within the statutory limitation period of two years from delivery.

The above restrictions and shortened periods do not apply to claims based on damages caused by us, our legal representatives, or agents:

  • in case of injury to life, body, or health
  • in case of intentional or grossly negligent breach of duty, as well as fraudulent intent
  • in case of breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
  • in cases covered by the scope of the Product Liability Act.

Liability

We are always fully liable for claims based on damages caused by us, our legal representatives, or agents:

  • in case of injury to life, body, or health
  • in case of intentional or grossly negligent breach of duty
  • in cases covered by the scope of the Product Liability Act.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or agents, the amount of liability is limited to the foreseeable damage typical for the contract at the time of its conclusion.

All other claims for damages are excluded.

Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
